City Council meets
On Thursday, March 19, Cottonwood Mayor Pepper Harman made a local
emergency declaration.
A mayor’s declaration is good for up to 7 days. On Monday, March 23,
the Cottonwood City Council held a special meeting and voted to extend
that emergency declaration for as long as the state has one in place.
This declaration enables any local businesses adversely affected by
the coronavirus pandemic to apply for aide.
The mayor’s and council’s declarations, in their entirety, can be found
below:
MAYOR’S DECLARATION OF LOCAL DISASTER EMERGENCY
CITY OF COTTONWOOD, IDAHO
WHEREAS, Idaho Code § 46-1011 authorizes the Mayor of a city to
declare a local disaster emergency; and
WHEREAS, Idaho Code § 46-1002(2) defines “disaster” as the “imminent
threat of widespread or severe damage, injury, or loss of life or property
resulting from any natural or manmade cause, including but not limited
to fire, flood, earthquake, windstorm, wave action, volcanic activity,
explosion, riot, or hostile military or paramilitary action and including
acts of terrorism;” and
WHEREAS, Idaho Code § 46-1002(3) defines “emergency” as the “occurrence
or imminent threat of a disaster or condition threatening life or property
that requires state emergency assistance to supplement local efforts to
save lives and protect property or to avert or lessen the threat of a disaster”;
and
WHEREAS, a declaration of local disaster emergency activates the response
and recovery aspects of applicable local or intergovernmental disaster
emergency plans for the furnishing of aid and assistance; and
WHEREAS, Idaho Code § 67-2808 authorizes the Council of the City
of Cottonwood to declare a local disaster emergency and that the public
interest and necessity may demand the immediate expenditure of public money
without compliance with formal bidding procedures; and
WHEREAS, the current global COVID-19 virus pandemic outbreak as addressed
by federal government, the Centers for Disease Control, and by the actions
and declarations of the President of the United States and the Governor
of the state of Idaho, constitutes an imminent threat of widespread or
severe damage, injury or loss of life or property of the citizens of, and
visitors to, city of Cottonwood requiring state emergency assistance to
supplement local efforts to save lives and protect property or to avert
or lessen the threat of a disaster;
NOW THEREFORE, the Mayor of the City of Cottonwood does hereby declare:
That a Local Disaster Emergency exists and that all efforts will be
made to protect the life and property of the citizens of the City of Cottonwood
through activation of all local disaster emergency plans and state emergency
assistance; and
That this Local Disaster Emergency shall expire within seven (7) days
unless the City Council expressly authorizes the continuance of such Declaration;
and
That this Declaration of Local Disaster Emergency (“Declaration”) shall
be promptly filed with the Idaho County Recorder’s Office; and
That prompt and general publicity shall be given by a press release
notifying the public of this Declaration.

CITY COUNCIL AFFIRMATION OF
LOCAL EMERGENCY DECLARATION
FOR THE CITY OF COTTONWOOD, IDAHO
WHEREAS, the President of the United States and the Governor of the
state of Idaho have declared a health emergency related to the current
COVID-19 virus global pandemic outbreak, and
WHEREAS, pursuant to Idaho Code § 46-1011 the Mayor of the city
of Cottonwood has declared a local disaster emergency on the 23rd day March,
2020 due to the current COVID-19 virus global pandemic outbreak; and
WHEREAS, the Mayor’s said declaration sets forth legal and factual
considerations in support of such declaration, and
WHEREAS, such declaration activates the response and recovery aspects
of applicable local or intergovernmental disaster emergency plans for the
furnishing of aid and assistance; and
WHEREAS, the City Council of the city of Cottonwood recognizes the
imminent threat of widespread and severe damage, injury or loss of life
or property of residents and visitors to the city of Cottonwood arising
from the COVID-19 global pandemic outbreak as addressed by the federal
government, Centers for Disease Control and by actions of the President
of the United States and the Governor of the state of Idaho, and
WHEREAS, the City Council of the city of Cottonwood further recognizes
that the aforesaid disaster emergency requires state emergency assistance
to supplement local efforts to protect life, health and property within
the city of Cottonwood; and
WHEREAS, Idaho Code § 67-2808 authorizes the Council of the city
of Cottonwood to declare an emergency and that the public interest and
necessity may demand the immediate expenditure of public money without
compliance with formal bidding procedures; and
WHEREAS, a local disaster emergency declaration must be filed with
the county recorder’s office and “given prompt and general publicity.”
NOW THEREFORE, the City Council of the City of Cottonwood does hereby
declare:
That a Local Disaster Emergency exists and that all efforts will be
made to protect the citizens and property of the City of Cottonwood through
activation of all local disaster emergency plans and state emergency assistance;
and
That this Local Disaster Emergency shall continue until the City Council
expressly revokes or terminates such Declaration, or as otherwise may be
provided by law; and
That this Declaration of Local Disaster Emergency (“Declaration”) shall
be promptly filed with the Idaho County Recorder’s Office; and
That prompt and general publicity shall be given by a press release
notifying the public of this Declaration.
